Terms of Service

1. Agreement

These Terms of Service are an agreement between you and [Legal entity name], the operator of Vaka Live. By creating an account or using the app you accept them. If you do not accept them, do not use Vaka Live.

Our Privacy Policy explains how we handle your personal information and forms part of this agreement.

2. Who can use Vaka Live

You must be at least 18 years old and legally able to enter into this agreement. You must not use Vaka Live if you are barred from doing so under any applicable law or sanctions regime, or if we have previously closed your account.

By using Vaka Live you confirm you meet these requirements. We may ask you to verify your age or identity, and may suspend access until you do.

3. Your account

• Give accurate information when you register and keep it up to date.
• Keep your password and your device secure. You are responsible for what happens on your account, so tell us straight away if you think someone else has access.
• One account per person, unless we agree otherwise in writing. Accounts may not be sold, rented or transferred.
• Your Vaka ID is a public identifier. Your host code is not — it lets an agency attach you, so treat it as a secret.
• Do not impersonate anyone, and do not use a name, photo or bio you do not have the right to use.

You can delete your account in the app at any time. Deleting it does not cancel obligations already incurred, and does not entitle you to a refund of unspent coins.

4. Community rules

Vaka Live is a live platform, so what you do is visible to other people in real time. You must not use it to:

• post or broadcast sexual content involving minors, or any content that sexualises a minor — this results in an immediate permanent ban and a report to the authorities;
• share nudity or sexually explicit material, or solicit sexual services;
• harass, bully, threaten, stalk or incite violence against anyone;
• promote hatred against people based on race, ethnicity, national origin, religion, disability, sex, gender identity or sexual orientation;
• share someone's private information without their consent;
• post content that is illegal where you or your audience are, or that infringes someone else's rights;
• sell or promote drugs, weapons, gambling or other regulated goods;
• run scams, phishing, pyramid schemes, or solicit money under false pretences;
• manipulate gifting, levels, rankings, tasks or games — including self-gifting to inflate earnings, coordinated gifting rings, bots, or multiple accounts;
• scrape, reverse-engineer, overload or interfere with the service, or circumvent any limit, ban or security measure;
• record or redistribute another user's broadcast without their consent.

Hosts are responsible for their rooms and for the conduct they allow in them. Room moderation tools are provided so you can act — failing to act on serious conduct in your own room is itself a breach of these rules.

5. Your content

You keep ownership of everything you post, broadcast or upload.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for formatting and delivery), transmit and display your content, for the purpose of operating, promoting and improving Vaka Live. This licence lasts as long as your content is on the platform, and continues afterwards only for copies retained in backups or needed for safety and legal records.

You confirm you have the rights needed to grant this — including for any music you play in a room. We may remove content that breaches these terms or the law, and we may retain records of removed content for safety and legal purposes.

6. Coins, gifts and virtual items

Coins are the in-app currency used to send gifts and access certain features. Beans are what a host receives when they are gifted.

• Coins are a limited, personal, non-transferable licence to use a feature of the app. They are not money, not a deposit, not a stored-value instrument, and carry no value outside Vaka Live.
• Coins are obtained through the channels we make available in the app, including authorised coin sellers. Buying coins anywhere else is at your own risk, may be fraudulent, and may get your account closed.
• Purchases are final and non-refundable once coins are credited, except where a refund is required by law or by the app store's own policy.
• Gifts, including lucky gifts and game outcomes, are entertainment features. Some involve an element of chance; where a gift can return a variable amount, the mechanic is described in the app.
• We may change gift prices, conversion rates, features and the coin catalogue. We will not reduce coins already credited to your balance.
• Coins have no cash value on account closure, expiry or termination of the service, except where the law says otherwise.

7. Creator earnings and withdrawals

If you host, gifts sent to you convert into beans, which can be withdrawn subject to this section.

• The current conversion rate, minimum withdrawal amount, any fees, and processing times are shown in the app and may change. Changes apply to future withdrawals, not to a request already accepted.
• Withdrawals are reviewed before payment. We may ask you to complete identity or face verification, confirm ownership of the payout account, or explain unusual activity.
• We may withhold, reverse or freeze a withdrawal where we reasonably believe it involves fraud, chargebacks, stolen payment credentials, gifting manipulation, or a breach of these terms — and while any investigation is open.
• You are responsible for the payout details you enter. We are not liable for funds sent to an account you entered incorrectly.
• You are responsible for your own taxes. You are an independent user of the platform, not our employee, partner or agent, and nothing here creates an employment relationship.
• Where required, we may report earnings to tax or regulatory authorities.

8. Agencies and hosts

Hosts may join an agency. If you do:

• the agency can see your performance and earnings figures, and may support, target or manage you under its own arrangement with you;
• any commission or revenue split is a matter between you and the agency unless the app states otherwise;
• we are not a party to your agreement with the agency and are not responsible for its conduct or promises;
• agencies must not misrepresent Vaka Live, recruit minors, or require conduct that breaches these terms. Agencies that do lose their status, along with any related privileges.

9. Suspension and termination

We may warn, mute, remove from mic, suspend, ban a device, or permanently close an account that breaches these terms or presents a risk to other users or to the platform. Where it is reasonable to do so we will tell you why and how to appeal — but for severe breaches, particularly those involving minors, we act immediately.

If we close your account for a breach, unspent coins and unwithdrawn beans may be forfeited. If we close it for any other reason, we will process any legitimate outstanding balance in the normal way.

You can stop using Vaka Live and delete your account at any time.

10. Third-party services and stores

Vaka Live is distributed through app stores and relies on third-party infrastructure. Their terms apply alongside these, and where you buy through an app store, that store's refund policy governs the purchase.

Vaka Live is not sponsored or endorsed by any app store, and any store is not responsible for the app or for supporting it.

11. Disclaimers

Vaka Live is provided "as is" and "as available". To the fullest extent the law allows, we do not warrant that the service will be uninterrupted, secure, or free of errors, that streams will be of any particular quality, or that you will earn any particular amount.

We do not control what other users say or do. Interactions with other users, agencies and coin sellers are at your own risk, and we make no promises about their conduct.

Nothing here excludes rights you have as a consumer that cannot legally be excluded.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for lost profits, lost earnings, lost data, or loss of goodwill.

Our total liability arising out of or relating to Vaka Live is limited to the greater of the amount you paid us in the [12] months before the event giving rise to the claim, or [amount and currency].

13. Indemnity

You agree to indemnify us against claims, damages and reasonable costs arising from your content, your use of Vaka Live, or your breach of these terms or of anyone else's rights.

14. Changes to these terms

We may update these terms as the service develops. We will post the updated version here with a new date and, for material changes, give notice in the app before they take effect. Continuing to use Vaka Live after that means you accept the updated terms.

15. Governing law and disputes

These terms are governed by the laws of [Jurisdiction], and the courts of [Jurisdiction] have exclusive jurisdiction, except where the law of your country of residence gives you the right to bring proceedings locally.
